Overview of Florida Mold Law Grandfathering Clause

Grandfathering: Applicants must submit an application to the department by March 1, 2011, whether postmarked or delivered by that date, and meet the following licensure requirements:

Option 1: Certification Route

  • Certification by a state or national association that requires:

    • Successful completion of a proctored exam for certification

    • Completion of at least 60 hours of verifiable education for a mold assessor

    • Completion of at least 30 hours of verifiable education for a mold remediator

Option 2: Experience Route

  • At the time of application, have at least 3 years of experience as an assessor or remediator

  • To establish this experience, the applicant must submit at least 40 invoices they prepared

  • The department may investigate the validity of these submitted invoices

Additional Grandfathering Requirements for Mold Licensure

  • Applicants must submit to a criminal background check and be of good moral character

  • Mold assessors must obtain a $1,000,000 insurance policy covering both preliminary and post-remediation assessments

Restrictions That May Disqualify Applicants

An applicant may not qualify for licensure if any of the following apply:

  • They have had a mold-related services license revoked at any time

  • They have had a license suspended within the previous 5 years

  • They have been assessed a fine exceeding $500 within the previous 5 years

Related Fields That May Affect Eligibility

A license in a related field includes, but is not limited to:

  • Real estate

  • Construction

  • Mold-related services

  • Building code administration or inspection
